Terms

The terms covering use of this site, what you may do with our scores, and the limits of what we promise.

These terms govern your use of thecorkreview.com. By using the site you accept them. If you do not accept them, stop using the site. The publisher is identified at the foot of this page, and in these terms “we” and “us” mean that company.

Separate terms apply to the paid business licence and are set out in the licence terms on the business page. Where the two disagree about the licence, those terms win.

Using the site

You may read the site, link to it, and quote from it within the limits set out below. That is what it is here for and no permission is needed.

You may not:

  • copy, scrape, crawl, harvest, or systematically extract the site or any substantial part of it, whether by hand or by any automated means, including for the purpose of training a machine learning model;
  • circumvent, disable, or interfere with any security or rate limiting we apply;
  • probe, scan, or test the vulnerability of the site or any system it runs on;
  • use the site to send unsolicited email, distribute malware, or do anything unlawful;
  • impersonate us, or represent that we endorse you, your company, or a product; or
  • resell, redistribute, or make the content available as a substitute for reading it here.

The content is ours

Scores, tasting notes, guides, photographs, and the underlying database of producers, vineyards, and regions are the copyright of the publisher unless stated otherwise. The name The Cork Review and the look of this site are ours as well.

Reading the site is free and quoting us editorially is free. Using what is on it to sell wine is licensed, and the sections below set out where that line falls.

Quoting us

You may quote a score together with a short extract of the tasting note, in editorial or personal contexts, provided you:

  • attribute it to The Cork Review;
  • link to the specific review page you are quoting, not to the homepage;
  • state the vintage, because a score belongs to a vintage and is meaningless without it; and
  • do not alter the score or edit the note in a way that changes its meaning.

Commercial use is licensed

Quoting us editorially is free. Putting a score where you sell wine is not. These need a licence:

  • reproducing scores or notes in retail listings, shelf talkers, point-of-sale material, packaging, or advertising; and
  • reproducing more than a short extract of a note.

Both are covered by the business licence, an annual subscription for wineries, importers, distributors, and retailers. It grants those rights outright for as long as it runs, so there is nothing to apply for and no permission to wait on. What it does and does not allow is set out in full on the licence terms.

Paying for a licence buys the right to republish a score we have already published. It buys no influence over what we review or how we score it.

What we do not license at all

Two things are unavailable on any terms, to subscribers and non-subscribers alike:

  • systematically copying, scraping, or republishing our database or any substantial part of it; and
  • using our name or marks in a way that implies endorsement of a producer, retailer, or product.

Anything not covered above, ask on the contact page rather than assuming.

Scores are opinions

A score is one or two people’s judgement of a bottle on a stated date, published as opinion and as nothing else. Bottle variation, storage, serving temperature, and the passage of time all mean your bottle may not be our bottle.

Nothing here is a warranty about a wine’s condition, provenance, authenticity, legality in your market, or fitness for any purpose. Nothing here is investment advice, and wine bought on the strength of a score can and does fall in value. We are not liable for purchasing decisions made on the basis of a review.

Prices are recorded at the time of tasting, in US dollars, and go out of date immediately.

Accuracy and corrections

We try to get technical detail right and we correct errors when told about them. We do not guarantee that everything on the site is accurate, complete, or current. If something is wrong, tell us on the contact page.

The newsletter

The newsletter is free, and subscribing is optional. Every send carries a one-click unsubscribe link. What we store and for how long is on the privacy page. We may stop sending it, or change what it contains, at any time.

We link to producer and retailer websites for reference. Those sites are not ours, we do not control them, we do not vouch for them, and we are not responsible for anything on them or for anything that happens to you there.

Alcohol and age

This site is about alcoholic drinks and is intended only for people of legal drinking age in their own jurisdiction. By using it you confirm that you are. Nothing here encourages excessive or irresponsible drinking.

The site is provided as it is

The site is provided on an “as is” and “as available” basis. To the fullest extent the law allows, we disclaim all warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the site will be uninterrupted, timely, secure, or error free, and we may change, suspend, or withdraw any part of it at any time without notice.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is so, the exclusions above apply only as far as that jurisdiction permits, and nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Limit of our liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, punitive, or exemplary loss, or for lost profits, lost revenue, lost goodwill, lost data, or business interruption, however caused and on any theory of liability, whether or not we were told such loss was possible.

Our total liability to you for all claims arising out of or relating to the site or these terms is limited, in aggregate, to the greater of the amount you have actually paid us in the twelve months before the claim arose, or one hundred US dollars.

If you cause us a loss

You agree to indemnify us against any claim, demand, loss, liability, or reasonable legal cost arising out of your use of the site, your breach of these terms, or your use of our scores or notes in a way these terms do not permit.

Suspending access

We may restrict or withdraw your access to the site, without notice and at our discretion, if you breach these terms or if we reasonably believe you are attempting to. Where a business licence is affected, the process in the licence terms applies instead, and it requires us to ask first.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. You and we submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of them.

If you are a consumer resident in the UK or the EU, this does not deprive you of the protection of any mandatory rule of your own country’s law, or of your right to bring proceedings there.

Odds and ends

If any provision of these terms is held unenforceable, the rest continue in force and the unenforceable provision is applied as far as it lawfully can be.

Our not enforcing a provision on one occasion is not a waiver of it on another.

You may not transfer your rights under these terms to anyone else. We may transfer ours to a company that acquires the publication.

These terms, together with the privacy policy and, where you hold one, the licence terms, are the entire agreement between us about the site.

Changes

We may update these terms. Material changes will be described here rather than silently swapped in, and the date at the top will move. Continuing to use the site after a change means you accept it.
